By accessing or using the Talk Small Business mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. TSB LLC ("Company," "we," "us," or "our") reserves the right to modify these Terms at any time.

2. Description of Service

Talk Small Business provides a voice-first AI platform that enables small business owners to delegate administrative tasks through voice commands. Our AI agents assist with dispatching, collections, marketing campaigns, and integration with third-party business tools.

3. Account Registration and Security

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized access or security breach
  • Be responsible for all activities under your account

4. Subscription and Payment

The App may be offered on a subscription basis. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless canceled prior to the renewal date. Fees are non-refundable except as required by law or as specified in our refund policy.

5. Third-Party Integrations

The App integrates with third-party services to perform tasks on your behalf. By authorizing these integrations, you grant us permission to access and use the necessary data from those services. We are not responsible for the actions, policies, or content of third-party services.

6. Voice Data and AI Processing

When you use voice commands, we collect and process your voice data to provide AI-driven task execution. Voice data is processed securely and may be retained to improve our AI models. You may request deletion of your voice data at any time.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any regulations
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the App's functionality
  • Use the App to transmit malicious code or harmful content
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to harass, abuse, or harm others

8. Intellectual Property

The App, including all content, features, and functionality, is owned by TSB LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your business purposes.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. AI-GENERATED OUTPUTS MAY CONTAIN ERRORS AND SHOULD BE REVIEWED BEFORE RELYING ON THEM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSB LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE APP.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Vermont, USA, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Vermont.
